These Terms of Service (“Terms”) govern your access to and use of RxPets.net (the “Site”), including purchases of products offered under the Rx Pets brand.

Rx Pets is a brand of Rx Sports, LLC (“Rx Sports,” “Rx Pets,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or purchasing a product, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Site.

1. ELIGIBILITY

You must be legally capable of entering into a binding agreement to use the Site or purchase products.

Certain products may be subject to age, shipping, or other restrictions. By ordering a restricted product, you represent that you satisfy all applicable requirements.

We reserve the right to refuse or cancel transactions where we reasonably believe a transaction violates applicable law, these Terms, or our policies.

2. RX PETS PRODUCTS

Rx Pets offers products intended for animals, which may include hemp-derived cannabinoid products, treats, oral products, topical products, supplements, wellness products, and related merchandise.

Product availability, formulation, ingredients, cannabinoid concentrations, packaging, pricing, and specifications may change without notice where permitted by law.

Product photographs and website images are illustrative. Packaging or product appearance may differ from images displayed online.

3. IMPORTANT VETERINARY AND ANIMAL-HEALTH DISCLAIMER

Information provided through RxPets.net is for general informational and educational purposes and is not veterinary advice.

Rx Sports, LLC is not a veterinary practice, and information appearing on the Site is not intended to replace consultation, diagnosis, treatment, or advice from a licensed veterinarian.

You should consult an appropriately licensed veterinarian regarding your animal’s health and before introducing a new supplement or cannabinoid-containing product, particularly if your animal:

• Has an existing medical condition;
• Is pregnant or nursing;
• Is taking prescription or nonprescription medications;
• Is undergoing medical treatment;
• Has known allergies or sensitivities; or
• Experiences an adverse reaction.

If you believe an animal is experiencing a medical emergency, seek appropriate veterinary care immediately.

4. CBD, CBDA, HEMP, AND CANNABINOID PRODUCTS

Certain Rx Pets products may contain hemp-derived cannabidiol (“CBD”), cannabidiolic acid (“CBDA”), other cannabinoids, terpenes, botanical ingredients, or other compounds.

Laws and regulatory requirements governing hemp-derived products and products intended for animals continue to evolve and may vary by jurisdiction.

It is the purchaser’s responsibility to determine whether possession, purchase, use, or delivery of a product is permitted in the purchaser’s jurisdiction.

Rx Sports, LLC reserves the right to restrict or discontinue sales or shipments to any jurisdiction.

5. PRODUCT CLAIMS

Unless expressly permitted by applicable law, statements on RxPets.net regarding ingredients or products are not intended to represent that any product diagnoses, treats, cures, prevents, or mitigates any disease or medical condition.

References to wellness, calmness, mobility, joint support, digestive support, recovery, comfort, stress, or similar subjects describe intended wellness positioning or ingredient characteristics and should not be interpreted as a guarantee of a particular therapeutic outcome.

Individual animals may respond differently to products.

6. RESPONSIBLE PRODUCT USE

You agree to:

• Read the complete product label before use;
• Follow applicable product directions;
• Observe serving or dosage guidance provided with the product;
• Consider your animal’s species, size, age, health, and other relevant factors;
• Keep products appropriately stored and secured;
• Keep products away from children and animals for whom they are not intended; and
• Discontinue use and seek appropriate veterinary guidance if an unexpected or adverse reaction occurs.

Do not exceed labeled directions unless instructed by an appropriately licensed veterinarian.

Products formulated for one species should not be administered to another species unless the product labeling expressly permits such use or a veterinarian advises otherwise.

7. NO GUARANTEE OF RESULTS

Animals vary significantly in physiology, health status, size, metabolism, diet, medications, and response to ingredients.

Accordingly, Rx Sports, LLC does not guarantee that any Rx Pets product will produce a particular outcome or result for any individual animal.

Testimonials, reviews, case studies, endorsements, and customer experiences reflect individual experiences and do not constitute guarantees that another animal will experience the same results.

8. PRODUCT INFORMATION AND INGREDIENTS

We attempt to provide accurate product descriptions and ingredient information.

Product formulations, packaging, ingredients, serving recommendations, or specifications may change. You should always review the physical product label before administering a product.

If information appearing on the Site differs from the current physical product label, contact us before use if the difference could affect safe administration.

9. ORDERS

Submitting an order constitutes an offer to purchase.

We reserve the right to accept, reject, limit, or cancel an order, including because of:

• Product availability;
• Pricing or listing errors;
• Suspected fraud;
• Payment problems;
• Shipping restrictions;
• Regulatory requirements; or
• Suspected resale or misuse.

An automated order confirmation does not necessarily constitute final acceptance of an order.

10. PRICING AND PAYMENT

Prices are displayed in U.S. dollars unless otherwise indicated.

Applicable taxes, shipping charges, and other charges will be disclosed during checkout where practicable.

You represent that you are authorized to use any payment method submitted for a transaction.

We may correct pricing, typographical, or product-information errors and may cancel affected orders where permitted by law.

11. SHIPPING AND DELIVERY

Shipping estimates are estimates and are not guaranteed unless expressly stated.

Rx Sports, LLC is not responsible for delays caused by carriers, weather, natural disasters, governmental actions, inaccurate delivery information, or circumstances beyond our reasonable control.

We may restrict shipping based on product type, jurisdiction, carrier requirements, or applicable law.

12. RETURNS, REFUNDS, AND CANCELLATIONS

Purchases are subject to the return, refund, shipping, and cancellation policies displayed on RxPets.net at the time of purchase.

Because certain animal wellness products are consumable, ingestible, or subject to safety and quality-control requirements, opened products may be ineligible for return except where required by law or where a product is defective or incorrectly shipped.

Nothing in these Terms limits rights that cannot lawfully be waived.

13. PRODUCT SAFETY AND ADVERSE EVENTS

If you believe an animal has experienced an adverse event potentially associated with an Rx Pets product, discontinue use where appropriate and contact a veterinarian.

• Product name;
• Lot or batch number, if available;
• Approximate amount administered;
• Date and time of administration;
• Species and approximate weight of the animal; and
• A description of the event.

For urgent situations, contact a veterinarian or appropriate animal emergency service rather than waiting for a response from Rx Pets.

14. ACCOUNTS

If the Site permits customer accounts, you are responsible for maintaining the confidentiality of your login credentials and for activities conducted through your account.

Notify us promptly if you suspect unauthorized access.

We may suspend or terminate accounts reasonably believed to be involved in fraud, unlawful activity, misuse, or violations of these Terms.

15. ACCEPTABLE USE

You may not:

• Use the Site for unlawful purposes;
• Attempt to gain unauthorized access to the Site or related systems;
• Introduce malware or harmful code;
• Scrape or systematically extract Site content without authorization;
• Interfere with Site security or operation;
• Impersonate another person or organization;
• Use fraudulent payment information;

• Infringe intellectual-property or privacy rights; or
• Use Rx Pets content or trademarks without authorization.

16. INTELLECTUAL PROPERTY

The Site and its content, including without limitation:

• Rx Pets and Rx Sports names and marks;
• Logos;
• Product names;
• Packaging;
• Product photographs;
• Graphics;
• Videos;
• Text;
• Website designs;
• Formulations and proprietary product information to the extent legally protectable; and
• Other brand materials

are owned by or licensed to Rx Sports, LLC and are protected by applicable intellectual-property laws.

No license or ownership interest is granted except the limited right to use the Site for lawful personal purposes in accordance with these Terms.

17. REVIEWS, TESTIMONIALS, AND USER CONTENT

If you submit reviews, photographs, videos, testimonials, comments, or other content (“User Content”), you represent that you have the right to submit it and that it does not violate applicable law or third-party rights.

Unless otherwise agreed in writing, you grant Rx Sports, LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish User Content in connection with operating, promoting, and marketing Rx Pets and Rx Sports, subject to applicable law.

We may remove User Content that we reasonably believe is unlawful, misleading, infringing, inappropriate, or inconsistent with our policies.

We may also moderate or decline to publish testimonials or reviews containing impermissible medical or therapeutic claims.

18. THIRD-PARTY SERVICES AND LINKS

The Site may contain links to or integrations with third-party services.

Rx Sports, LLC does not control those services and is not responsible for their content, availability, security, privacy practices, products, or services.

Your dealings with third parties are governed by their applicable terms and policies.

19. PROMOTIONS AND DISCOUNTS

Coupons, promotional codes, affiliate discounts, ambassador discounts, and other offers may be subject to separate conditions.

Unless expressly stated otherwise:

• Promotions cannot be combined;
• Discounts have no cash value;
• Promotions may be limited or discontinued;
• Promotional codes may not be resold; and
• We may reject fraudulent or unauthorized use.

20. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

RX SPORTS, LLC DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED BY LAW OR IN A WRITTEN PRODUCT WARRANTY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

21. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RX SPORTS, LLC AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SITE, PRODUCTS, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RX SPORTS, LLC’S AGGREGATE LIABILITY ARISING FROM A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply where liability cannot lawfully be excluded or limited.

22. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Rx Sports, LLC and its affiliates, officers, members, managers, employees, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Site, violation of these Terms, or infringement of third-party rights.

This provision does not require a consumer to indemnify Rx Sports, LLC for conduct for which indemnification cannot lawfully be required.

23. GOVERNING LAW

These Terms are governed by the laws of the state in which Rx Sports, LLC is organized or maintains its principal place of business, as identified in the company’s then-current legal notices, without regard to conflict-of-law principles, except to the extent applicable consumer law requires otherwise.

Before publication, Rx Sports, LLC should replace this section with its intended governing state and forum.

24. DISPUTE RESOLUTION

Before commencing formal legal proceedings, you and Rx Sports, LLC agree to make a reasonable good-faith effort to resolve disputes informally by providing written notice describing the dispute and requested resolution.

Notices to Rx Sports, LLC should be sent to:

The parties will have at least 30 days after receipt of a complete notice to attempt informal resolution before filing a claim, except where immediate legal relief is reasonably necessary or applicable law provides otherwise.

Rx Sports, LLC should obtain counsel’s approval before adding mandatory arbitration, a class-action waiver, or a specified exclusive forum.

25. FORCE MAJEURE

Rx Sports, LLC will not be responsible for delays or failures caused by circumstances reasonably beyond its control, including natural disasters, severe weather, epidemics, governmental actions, transportation interruptions, carrier disruptions, labor disputes, utility failures, supply-chain interruptions, or similar events.

26. SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain effective.

27. NO WAIVER

Failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

28. CHANGES TO THESE TERMS

We may revise these Terms periodically.

The revised Terms will be posted on RxPets.net with an updated effective or “Last Updated” date. Where legally required, we will provide additional notice or obtain consent before materially revised Terms become applicable.

29. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional policies expressly incorporated into them, constitute the agreement governing your use of the Site and purchases through RxPets.net.
